2000 BMW 323 spits out oil of transmission

On a cold morning at about 30 degrees, I start car, put in drive and sometimes reverse, the car does not want to go and will spit transmission fluid out. When you shut engine off and restart it then seems to be ok. This is a gm transmission built in late 1999.
The hydrolic pressure is lost after it spouts off fluid. When you shut it off and restart the car will go with no problem. Any ideas or suggestions?

My mechanic serviced the tranny with new filters and oil and disassembled and cleaned the valve body.
Now on even the coldest of mornings the trans works
just great. This was done for under 400 dollars without the help of the losers on this site.
