Is the trans fluid clean and full? Have any warning light come on?

Its full, I dont know about clean I havent had any filters changed since I had it. It feels like the emergency brake is on when in gear

Could it be the filter or dirty transmission fluid. How do you tell?

A filter wouldn't do that. In gear, does the engine rev or does it sound loaded down?
