Transmission not engaging gears

I was driving from work and my transmission down shifted itself barely made it home I noticed it would go to second gear I checked the transmission fluid and it's really dark and smells burnt now when I put the car in park or neutral it makes a whining noise but as soon as I put it into drive or reverse the noise stops but the car doesn't move

If the fluid level is good, and the fluid looks and smells burnt then most likely that transmission has burned out. I would look into replacement, but not before professionally diagnosed.
