Try jacking up one of the drive wheels (attached to drive axle) off the ground to release the tension off the transmission. You should hear a slight pop noise when tension is released. If this does not work you need to check the brake switch and neutral safety switch and transmission linkage

The brake switch would be the logical anwser, however the car had to be lifted to mercedes where they say the linkage (of which there is an electrical component/ has to be replaced.

I was told by the service dept that MB would pay for half and I would be responsible for half.

?

This car has 37,000 miles on it. What gives?

It is very puzzling why they would agree to pay half the cost's? I cannot find any recalls or TSB's which specifically relate to the transmission not shifting out of park or to the brake pedal/control system.
It is possib;e they are doing other work under warrenty/recall whilst fixing the problemask the dealer why they have agree to pay half the cost's

I did find these and one is a recall. And may or may not be related to your original problem? Please let me know the outcome

SERVICE INFORMATION
This Recall Campaign has been initiated because DCAG has determined that on the affected vehicles (see VIN range below), in certain instances, the Sensotronic Brake Control (SBC) pump motor may run out of permissible tolerances, thereby triggering the hydraulic back up function mode. In the hydraulic back up mode, the driver has braking power sufficient to stop the vehicle, although greater brake pedal pressure is required and the brake pedal travel will be noticeably longer which could lead to a vehicle crash. The recall will be conducted in order to re-program the SBC Hydraulic unit.

Attached is a sample copy of a letter which owners of the affected vehicles will receive.
Prior to performing this Recall Campaign:
Please check VMI to insure the vehicle is involved and to determine if the vehicle has been previously repaired.

Vehicle Will Not Shut-Off When Using Keyless-Go
SERVICE INFORMATION
If you encounter customer reports in the above models of a condition where the vehicle cannot be shut-off with either the Keyless-Go card or Smart key, after the vehicle was initially started with the Keyless-Go card, perform the following procedure.
Replace the Electronic Shifter Module. Refer to the following WIS document AR27.60-P-0901R.
NOTE:Ensure that STAR Diagnosis is loaded with at least software version 04/2003 prior to ESM replacement. It is necessary that the ESM be programmed according to the proper vehicle type.

Using STAR Diagnosis, perform a Short Test and erase all stored diagnostic fault codes.
Verify proper operation of the vehicle using both the Keyless-Go card(s) and Smart key(s).
NOTE:In cases where the battery was disconnected or control module powered fuses were removed, normalization of the vehicle's electrical system will be necessary. Additionally ensure that all fuses or battery connections are properly secured. Refer to the following WIS documents AR54.10-P-0003R for model 230, and AR54.10-P-0003I for model 220/215.
