When you put the brakes on does the squeaking stop? If so its the brakes if not hten it proably is not.
Is it rythamatic with speed?

The noise occur both at times when I use the brake
and when i'm cruising at slow speeds without it
i can hear it very clear at speeds around 40mph
i was wondering if I should change the brakes and rotor to see if those are the problem. But I shouldnt have too if the mileage is only 40000?

I would physically look at the brakes if I were you. I would also look behind the rotor at the shield to see if it is pushed in and slightly touching the rotor as it turns. Even with 40000 miles the wear on the brakes in proportional to the type of driving you do and the braking habits you employ.
