'98 ML320-Transmission works fine for 15 or 20 miles, then when gets hot, won't shift into higher gears (about 3000 RPMs)

How is the tranny fluid level? Have you recently changed or flushed the fluid and/or filter?

Does turning the engine off and restartng make any changes?
Does the lower gears shifts correctly when the OD is not achieved?
Get a scan done to check for trouble codes.
