2000 Ford Windstar transmission problems

When my car sits and cools down the car will go into gear with no problems and when it warms up it goes out of gear and won't move. Is this a transmission that is broken or is it the filter plugged or cracked? It also makes a sound like the pump in the tranny is trying to suck up the fluid but is not getting anything. Please HELP.

Check fluid level and color and let me know

Well the fluid level was fine but the color looked burnt. So I drained the fluid and put in a new filter and used the same gasket since it was reusable and it works great now. The place I bought the car from did not change the fluid so it was all original fluid and filter si ti was clooged.
