I am wondering if I need new torque converter, if the car drives fine until it goes over 40 mph?

Hello, I'm not sure of your tranny ID? I've seen faulty vacuum modulators cause a problem with shifting. If the vac line has tranny fluid in it, the modulator is faulty. Is there any tranny fluid in the air filter housing, on some models, I've seen that happen. Just a thought.
