Should I buy gas while a tanker is making a delivery?

I had contaminated gas after ******* up at a Kroger store while they were getting a delivery.

A brown sludge and what appeared to be water. My Chevy dealer had to remove and clean the gas tank.

If tank was really low and had lots of water in tank possible. What does station say? maybe others effected? Proper proceedure is to cut off pump on tank being filled to prevent contamination

Kroger's insurance company sent me a letter saying Kroger does not have water or sludge in their tanks.I took Kroger to Small Claims court and lost. I now have a lawyer and have filed again in Circuit court. The onus is still on me to prove the sludge and water came from their tank. I have not heard of anyone else having a problem at that particular store but have heard of others having problems at a different store.
I think I happened to be at exactly the wrong place at the wrong time. If I had come later, the tank probably would have settled down. I just wonder how common the problem is.

All underground tanks get water in them. They are checked a regular bases and records kept and sent to State Agriculture Commission so should be able to get. also tanker driver sticks tank at time of fill up so should be record there. ask lawyer about a professional witness from Auto Industry
