1996 Infiniti I30 Repair Question

Infiniti I30 Rpm Problem
The car acts like it isn't getting enough gas and is losing power. We are doing about 3500 rpms at 40 mph with the pedal to the floor.

Is the Malfunction Indicator Light showing?
3500 rpm at 40 mph, either the transmission is not upshifting or it is slipping.
