2010 Lexus RX 350 Stiff Brake Petal & Push Start Failur

2010 Lexus RX 350 6 cyl All Wheel Drive Automatic 1800 miles
We have a brand new RX350 and not to brew more problems for Toyota but I think their push-start system is defective. It fails to start the vehicle once in about 40 tries. The brake pedal stiffs up and when you hit the push-button start, it only lights orange and accessories turn on but the vehicle doesn't turn on. We already got stuck like this a few times and this Lexus just recommends changing the battries in the remotes. These are brand new remotes and it happens on both of them, so I don't buy it. I suspect the RFID is not syncing with the remote properly and thus the lock-up. Any idea what else could be causing it ?
