Check engine lite

I have a 1999 Chrysler LHS with a 3.5 Liter auto trans with 70736 miles. My problem is the check engine lite has been coming on for over a year when I pull up the code I get a P0700 what the book list as an eatx controller dtc present. The dealer replaced the controller about a year ago and since then it's done the same thing about 5 times symptoms are trans wont shift out of first the engine runs rough and the speed ometer does not work before every time I took it back to the dealer it would set all day or over night and the proble would correct itself or they would just reset the computer and it would be ok for a few months this time disconnecting the battery does not help. Can you help me with this?
About the VSS switch I have checked the voltage from the transaxle controll module at the connector to vss as per haynes repair manual and it reads.38 volts where the book says it should be 5.0 volts could thi be a bad module?

Have the input speed sensor checked.

I have learned from owning 2 Chryslers that you can replace numerous things and the Check Engine light will come on. My last Chrysler I put black electrical tape over the Check Engine light and it stayed there for 3 years. This one has been on there for 8 mths so far. I check it often because they say if it starts flashing THEN it's time to do something about it.
